Fair Debt Collection
Are you being harassed by debt collectors?
Problems in this area include abusive creditor tactics, difficulties in receiving meaningful response to disputes about a debt, the growing debt buyer industry and the sale and resale of ancient debts with little record keeping, and abuse of the court system. Freezing of protected Social Security and other exempt public benefits is and the growth and collection of medical debt are also growing problems.
Did you know that you have a right under the law to demand that a creditor stop calling and harassing you? That won't necessarily stop the creditor from filing a lawsuit to try to collect money, but you have many rights that you may not have known about. If you do get sued by a creditor, and the creditor has violated the Unfair Debt collection Practices Act, you may have valuable counterclaims against the creditor that might reduce the amount you owe, and you might even win the lawsuit.
I can sometimes represent clients based on the laws that allow a person to collect attorney fees from an abusive debt collector. Most of the time, however, I will need to work on a regular hourly basis. I'd be happy to discuss your particular case with you to see what remedies might be available to you.
